Was out riding in Julian the other day and came across this pickup truck stopped in the road, two bikers along side of the driver giving hime hell and another in front facing him with his arms waving.
The guy in the truck throws it into reverse, smokes the tires and heads backwards about 10 yrds(almost 10 meters) yeah I had my tape measure:D and smacks into me . I braced myself and put the front brakes on hard as I saw him coming. Bam! he hits me and then rides up over my front wheel and lifts the back of the truck off the ground.
the bike now stands by itself.
the guy that was waving his arms runs up to the driver and grabs the driver around the neck, I jump off the bike run up to the guy pull him away from the driver, who now commences to get out of the truck and pulls out a knife and say's "you want to fight then". Mean while i pulled the guy off of him.

The guy who I pulled off then say the knife and (saw Red) came back at him beat the shit out of him, told me that the guy had pushed the other 2 bikers off the road whilst they were trying to overtake him on a double yellow(thats a no go over here). People by this time had called the CHP saying a guy had caused an accident and was brandishing a knife.
The original 3 bikers got back on their bikes and rode off.
Friends of mine removed the drivers keys as it looked like he wanted to take off as well.

Well the cops arrived in a possy as well as a few paramedics and fire engines within a few minutes. They must have been hiding around the corner waiting for us to call.
Over here you are supposed to carry your registration and proof of insurance with you, and when involved in an accident swop the insurance and driver details. The guy tells us his insurance is at home and tells the CHP (California Highway Patrol) the same thing.
I was not hurt or or pissed off or anything, thinking his insurance will take care of the bike.. I get AAA to pick my bike up ( I have coverage for 100 mile radius free pick up to any destination of my choice.Which is part of the AAA card holder agreement. Get it delivered to MOTO Forza (benelli dealer), and call my insurance in the morning.
Now here cames the shit part. I get the police report - the other MOFO (mother F**er) did not have insurance and was cited. My insurance cannot get a fair market value on the Benelli as they are so scarce, so give me a value of $6400 what they want to pay out as well as take a $500.00 deductible.
Oh and the parts to repair it is over $13000.00 plus $2000.00 labour. So they total it (write it off.)
Accessories on the bike were about $2000.00. They want to reimburse me $500.00

NOW I AM PISSED and sad:(

I have refused the settlement value and will update on what happens next.
 
Thats a right kick in the b@ll*x mate!

Looking on the positive side though, given the gun culture over there, it's lucky the driver didn't have one of those to hand....

Insurance companies are the same the world over trying to stiff you, hope you get a decent settlement.

Is there no way you could sue the driver of the pick up?
And what happened to the other bikers? Did they just leave you to fend for yourself? So much for cameraderie!

I hate to hear about a fellow motorcycle rider having something like this happen. It's even WORSE to hear it was a fellow Benellisti in the USA. Cause, I'm sure you have as much of a hard time getting good parts and hooking it up as I do. Cant you decline the Initial settlement and get ahold of a government moderator? I'm sure a quote from your dealership and some key words like "Legal action" or "policy cancellation" might incur some slightly more cooperative results. If you want me to come down to CA from WA when I get home from Iraq, we can find the guy and run a TANK over his Pickup truck. See how he likes THAT? Dirty Bassard... Best of luck in fighting for a better settlement. Hope it goes well. Keep us posted.

now if there ever was a situation where F**K and S**T and quite a few other such words were to be used (a lot, and loud) this would be it!!! :mad: Truly sorry to hear about your bike! :bawl:

Hopefully your insurance company will come up with a more sensible and good offer so that you can be back on the road with identical (or even better) CR as soon as possible!

(and as stated by others - Glad you are ok and that the situation didn't escalate by someone drawing a gun! :) )
 
For F**Ks Sake mate, that's a real pisser ! I'd be fuming ! It's a complete piss take when people don't take insurance out, over here they can crush your vehicle if you don't have any insurance, tax etc,

they ought to do the same to the driver ! :mad:


I hope all gets sorted mate, at least the driver had a deserved smacking,

"We" are all reallly glad that you sustained no physical injury. A bike can always be replaced.

I have always had that same insurance fear. That the insurance company would not want to payout. I also had difficulties getting it insured at first because of the bikes being so rare. You need to bring them quotes for a replacement bike. They need to be made to understand.

Where you given the opportunity to buy the bike back. It would be a shame to have the bike get crushed. When parts are already so difficult to obtain.

Again we are glad you sustained no physical injury & that you get to be with your family and ride again another day.
 
What a terrible story, Paul, but glad you are OK.

The insurance company are doing what they all do, hoping you will accept the first offer, but it is totally unrealistic, and I am sure it will not be too hard for you to come up with evidence proving the real value, and cost of repairs. Perseverance should see that through OK.

The insurance company will no doubt pursue the pick-up driver through the courts for their costs, but that is not your worry. The only thing you will get stung for is your $500 deductible, or excess, as it is called over here. If you have legal cover included in your insurance, then they can claim that off the other driver too. The reality, though, is that it will remain your loss, as he probably doesn't have a pot to p#ss in, and you can't get blood out of a stone, as they say.:rolleyes: Maybe you can get it added to the repair costs by the nominated repairer....

Sorry to hear about the BS you have to go through. I went through the same crap with insurance when I wadded up my DB2. They wanted to give me 3k and keep the bike. After a couple weeks of working my way up the ladder of management, I wound up getting 13.5k and kept the bike!! I say go back and give the truck driver the ass whipping the other guys had in store for him!! Let me know when your settled up properly. I still have two new LE's for sale!!(Maybe only one if JR buys another from me).
 
Wow, that's frucked up.:mad: Glad your okay, definately sounds like the worse part of it all is the insurance issue:mad: , which is no surprise. Please tell me (and other US owners) that it's not Progressive Insurance?!!!:confused:

Will you be getting another Benelli?
 
Sorry to hear about your situation Paul .Yes the insurances will rip you off every time of which i know to well .When i got wiped out on my 9 month old buell i thought i would get the full value .No chance because i had done 17ooo miles in that time they said the milage was equal to about 6 years use .Needless to say i am still pissed off about it and i lost ÂŁ4500.00 on the bike and there was and is nothing i could do about it .Good luck m8 .

find a friendly solicitor and fight the insurance company where it will hurt them the most, through the local press, through motorcycle magazines and posters in bike shops; just keep your composure and keep your reasoning simple and consistent; most insurance companies will decide you're bad publicity and settle for a fairer amount.:)
got burnt several times till going to the state appeals court, where I was awarded a win and all costs, sadly the bike shop then cut corners, anyway now discovered there is 'agreed value' cover! usually just a bit extra and no hassles! for next time.

The insurance is AAA.
I had the opportunity to buy the bike back, but due to the cost of parts and time to get them I declined.
I had my fellow riders help me at the scene, The CHP would have cited those other riders that had left and possibly even arrested the one for assault. So I think the best thing for them to have done was leave.

did AAA ask too much for the remains?
there'd still have to be thousands in value as parts.
might Roland be encouraged to be interested?
a "Benelliforum worldwide spares inventory!" perhaps?

Paul. Sad to hear what happened.

In those moments, I am thinking how lucky I am that we have an insurance duty in germany. EVERY vehicle carries an insurance even the driver/holder don´t pay the rate.

Anyway, this doesn´t help you.

Hope you can get over it and decide to buy a new love.

Sorry to hear this. Hope things work out for you. They say 25% of the drivers in Cali have no insurance. I think you can get more money from AAA. Talk to Balz (Moto Forza owner) and see if he could help estimate the value of your bike.
 
nice modding with the rizzomas and levers... Still... weirdest styling on a tnt sport I've ever seen... Looks suspiciously like a CR! :doh:
